According to an article in the Cape Charles Mirror by Wayne Creed, Cape Charles has scheduled a public hearing on the subject of vacating a public right of way created to provide access to the Sustainable Technology Industrial Park in 1996.

Eyre Baldwin and South Port Investors, Inc. purchased the property from Northampton County.

On August 16, 2017 the Town received a letter from South Port Investors requesting support from the Town Council for the transfer of the subject lot from the County of Northampton to South Port Investors.

However, a letter to the town from Assistant County Attorney Thornton noted that certain procedural matters are required as a condition of vacating a public right of way.

The Code of Virginia requires a public hearing.
