In Accomack County Circuit Court Thursday, two individuals were sentenced on charges of having carnal knowledge of a minor.
The first case that of Howard Matthews Jr. of Tasley occurred when the defendant was left in charge of two 13-14-year-old females back in 2016. The defendant was convicted on November 10, 2016.
Defense attorney Garrett Dunham told the court that Matthews had been incarcerated for 13 months and had employment available to him upon his release. He requested that the sentence be time served. Commonwealth’s Attorney Spencer Morgan told the court that he could not explain the guidelines but the defendant was left in charge of 2 juveniles and had never taken responsibility for his conduct which would have a lasting effect for the victims.
Judge Lewis then told the Matthews that he was 49 years old when this crime was committed with 2 juveniles so he was going to exceed the guidelines and sentenced him to 10 years with all but 4 years suspended with probation indefinitely and good behavior for life. Matthews was remanded to the custody Sheriff for transportation to the state prison.
The second case was that of Davion Walker of Painter who was convicted of carnal knowledge on June 30, 2016, of a 14-year-old female. Defense attorney Garrett Dunham told the court this defendant had been incarcerated for more than 17 months and had made arrangements to be employed at Purdue upon his release and that in Walker’s case he was not much older than the victim.
Commonwealth’s Attorney Spencer Morgan told the court that the guidelines, in this case, were also low and that the defendant was only 19 years old at the time along with the victim admitting that she had told Walker that she was 17 years old when in reality she was only 14.
Judge Lewis then told the defendant that he felt this case was entirely different than the Matthews case since Walker and the victim were basically boyfriend-girlfriend, therefore, he was going to sentence him to 5 years with time serve. Lewis placed defendant to 3 years of probation with instructions to attend sex offender education classes.
