Accomack Board Passes Resolution to Update Solar and Battery Storage Zoning Ordinances

Accomack County officials are preparing to update the county’s zoning ordinance following recent changes to Virginia state law affecting solar energy projects and battery storage systems.

At Wednesday’s  Board of Supervisors meeting, AccomackCounty staff presented Board members with an overview of new requirements created by House Bill 711, Senate Bill 347, and Senate Bill 443. The legislation will require local governments across Virginia to revise zoning regulations governing renewable energy facilities.

Under House Bill 711 and Senate Bill 347, certain ground-mounted solar facilities must be treated as conditional uses in agricultural, business, industrial, and mixed-use zoning districts. The laws also require localities to adopt specific regulations for the development and operation of solar facilities.

Meanwhile, Senate Bill 443 expands opportunities for battery energy storage systems. The measure allows battery storage facilities to be established as by-right accessory uses on properties already occupied by approved solar projects, provided they meet required safety standards and other applicable codes.

Following the presentation, county staff asked the Board to approve a resolution formally beginning the process of amending Accomack County’s zoning ordinance to comply with the new state mandates.

Officials say the changes are required by state law and will help ensure local regulations remain consistent with Virginia’s evolving approach to renewable energy development.
