A Cape Charles area couple were indicted on counts of construction fraud by a Northampton Grand Jury last July and are set to go to trial in 2025 for the 2021 allegations.

Direct indictments are warrantless allegations and are often not immediately included in public records by the court. The indictments are usually sealed by the judge until the suspects are arrested.

Indictments against contractor 55-year-old Brian Earl Twiddy, and his wife, real estate agent 54-year-old Cheryl Marie Twiddy, of Butler’s Bluff, get complicated.

The two were indicted on counts of advance pay construction fraud, embezzling more than $1,000, obtaining more than $1,000 by false pretenses, and maliciously filing a false lien in connection with Dec. 9, 2021 incidents. They were arrested in August 2024.

A grand jury that met in January 2024 did not find evidence to bring indictments on counts of grand larceny from July 2023 and another count of construction fraud from Dec. 2021 against Brian Twiddy.

Those two indictments were brought against Cheryl Twiddy were brought but a capias with orders to arrest her was withdrawn, and months later, the charges were marked as not being pursued.

Then in February 2024, a count of embezzling more than $1,000 against Cheryl Twiddy was taken to the grand jury and the panel did not find the evidence to bring an indictment.

They are set to go to trial on March 3, 2025.

The Twiddys have been associated with several companies and limited liability companies in the Tidewater area and on the Eastern Shore, including Twiddy Investments LLC, Upper Deck Construction LLC, and Shoreline Homes. It is unclear from online records, if the businesses are active or if the couple still reside on this side of the bridge-tunnel.

A July grand jury also brought ten unrelated indictments against 27-year-old Marie Nicole Williams, of Apricot Lane in Cape Charles that were not immediately available since she was arrested several weeks later. She was indicted on five counts of uttering and five counts of obtaining under $1,000 by false pretense on May 10, 2024. She has entered pleas of not guilty to the charges. A Feb. 10, 2025, trial date was set.
