Damien Howard was in Accomack County Circuit Court facing child endangerment, grand larceny, and Petit larceny 2nd offense charges.

Thursday when the case was called for the defendant it was announced that a plea agreement on charge one that being child endangerment had been reached, which reduced child endangerment to contributing to the delinquency of a minor therefore a misdemeanor charge versus a felony.

Commonwealth’s Attorney Spencer Morgan said that the officer responded to the home of a 17-month-old child who was bruised badly and taken to the hospital. The father of the child was also charged when witnesses investigation stated that both men were very rough with the child. Morgan also told the court that the father was out of state but his rights had been terminated as a father.

Judge Lewis accepted the guilty plea for charge one as amended.

On the grand larceny and Petit larceny charge it was proffered by the Commonwealth that on April 22, 2017 the defendant had stolen two T-shirts from the T Shirt factory and that on April 23 he had stolen $692.19. Elizabeth Wolf Commonwealths Attorney Elizabeth Wolf told the court that the thefts were clearly recorded on security video. She also confirmed that restitution had been made in full.

Judge Lewis accepted both guilty pleas and continued both cases until December 4, 2017 for a presentence and guidelines to be prepared. The defendant was remanded to the custody Sheriff to await sentencing.
